Terms and Conditions of Sale

Article 1 — Purpose

These General Terms and Conditions of Sale (GTC) govern all sales of digital products concluded between NOVALTRIX, a sole proprietorship (micro-entrepreneur), SIRET [TO BE COMPLETED], email contactnovaltrix@gmail.com (the "Seller"), and any natural or legal person making a purchase on the novaltrix.fr website (the "Customer"). Any order implies unreserved acceptance of these GTC.

Article 2 — Products

NOVALTRIX markets exclusively digital products (PDF files, downloadable resources). The essential characteristics of each product (content, format, number of pages) are described on the product sheet. No physical goods are shipped.

Article 3 — Price

Prices are indicated in euros. VAT not applicable, article 293 B of the CGI. The applicable price is that displayed at the time of order validation. NOVALTRIX reserves the right to modify its prices at any time, without affecting orders already validated.

Article 4 — Order and Payment

Orders are placed online: product selection, shopping cart validation, information entry, secure payment (credit card and other methods offered via Shopify Payments). The sale is firm after payment confirmation. A confirmation email summarizing the order is sent to the Customer.

Article 5 — Digital Delivery

The product is delivered by email, in the form of a download link, immediately after payment confirmation (generally within 5 minutes). In case of non-receipt, the Customer checks their spam folder then contacts the Seller at contactnovaltrix@gmail.com. A new link is sent within 48 business hours.

Article 6 — Right of Withdrawal

In accordance with article L221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium, where the performance has begun before the end of the withdrawal period and with the consumer's prior express consent and express acknowledgement that they thereby lose their right of withdrawal.

By validating their order, the Customer expressly requests the immediate execution of the contract (immediate access to digital content) and acknowledges that they thus lose their right of withdrawal from the beginning of the download.

Article 7 — Legal Guarantee of Conformity

The Customer benefits from the legal guarantee of conformity provided for in articles L224-25-12 and following of the French Consumer Code for digital content. In case of a defective, unreadable, or non-conforming file, the Customer may request conformity of the content or, failing that, a refund, by contacting contactnovaltrix@gmail.com.

Article 8 — Intellectual Property and Use License

The products sold remain the intellectual property of NOVALTRIX. The purchase grants the Customer a personal and professional use license: the Customer may use the prompts and methods for their own projects and those of their clients. Prohibited actions include: resale, sharing, publication, or redistribution of the product itself, in whole or in part.

Article 9 — Liability

Products are provided as is. NOVALTRIX cannot be held responsible for the commercial or financial results obtained by the Customer as a result of using the products, nor for temporary site interruptions, nor for file loss after delivery — the Customer is advised to keep a copy of their downloads.

Article 10 — Personal Data

Collected data is processed in accordance with the Privacy Policy, in compliance with the GDPR and the French Data Protection Act.

Article 11 — Consumer Mediation

In accordance with article L612-1 of the French Consumer Code, the consumer Customer may, free of charge, have recourse to a consumer mediator in the event of a dispute not resolved directly with the Seller.

Article 12 — Applicable Law

These GTC are governed by French law. In the absence of an amicable resolution, any dispute will be brought before the competent French courts, subject to the protective rules applicable to consumers.
